Deprivation of Liberty Safeguards - Code of Practice

Like the Mental Capacity Act Code of Practice, this code has been issued by the Lord Chancellor in accordance with sections 42 and 43 of the Mental Capacity Act. This does not impose a legal duty to comply with the Act but if the guidance has not been followed, good reasons must be given as to why it has not been followed. Its focus is mainly on the deprivation of liberty safeguards which apply to people in hospitals and care homes who are deprived of their liberty.
