hello I am looking for advice.

My Father is looking to buy a property for my Sister, who has a learning Disability and some of he friends and is looking for advice on how to set this up. It might be that some element of care may be required for the tenants but primarily it should just be housing related support.

The questions we have are how does he set the property to pass either SP inspections or CQC inspections?
How do we set the house up inorder to have an element of shared living arrangements i.e. Kitchen, living room, dinning room but rooms are prviate dwelling.
and would it be easy for the tenants to apply for LHA for the rooms.
I have a little background with bot SP and CQC so can aid a little bit but we are interested in the legalities and how difficult a project this may be to achieve.

I'm also really interested in the legalities and practicalities of setting up a supported living house and the requirements to do this efficiently and effectively.
Such as CQC registration and how the packages of individuals need to be approached to form shared home.where there is likely to be varying levels of support required for each tennant.
I'm familiar with most elements of supported living and have individuals looking to link up as an alternative to residential care.

I read your question with great interest. It is a laudable idea and I would love it to succeed, but, before planning the finer points of how to organise the building, please look very carefully at the way it will be funded over the longer term.

The numbers involved will determine if CQC registration applies and, as far as SP funding support is possible, I suggest that you look to a more permanent solution to meet ongoing support need. Supporting People ( depending on area) may not exist as a longer term option, at best SP is being replaced in some locations by short term (6 week) interventions.

It appears that in your proposed scheme the needs of each individual will need assessing. There will be some guidance documents available from the local authority on substantial and critical eligibility. That assessment of need, depending on an additional financial assessment, may secure a direct payment or personal budget to fund part or all of the support element in the proposed service.

Aside from the care/support element of the service, rental income is the next consideration. Local Authorities, RSLs and Voluntary Organisation who charge rent in supported accommodation can draw on Housing Benefit to fund rent for eligible occupants. However, the scheme you propose will identify the landlord as a private provider and, as a private landlord, the scheme residents will be limited to Local Housing Allowance. LHA is a specific and limited payment with different values depending on a local valuation. There may be some concessions for young people leaving care, but generally it is less for single people under 35 and for those in shared accommodation. Values can be found "online" against the local area coding.

The local Authority can advise and may help with adaptions to a property as different needs arise, but the need to recoup management costs through rents is somewhat limited with LHA. The net difference in income potential between the private sector and social sector landlord types will be significant and may put your scheme at some disadvantage.

The approach you suggest in your question is clearly what HMG intended when legislation intending to support choice and care in the community was envisaged. The practicalities are, however, a little more difficult to resolve.

Hi - we have set up a number of supported living solutions in Sunderland with private owners / landlords similar to the arrangement you have outlined without any issues. However, we have done this by supporting the private landlord owner to set up an arrangement with a registered housing provider (housing association) who will become the management agent and can set the rent, liaise with housing benefit with the aim to achieve exempt accommodation rates for the ingoing tenants based upon this being independent living - supported housing. The Registered provider also commissions the care service which will be able to provide the care and support required by the individuals moving into the scheme. The Care Service will apply for CQC registration in advance of occupancy. Schemes we have established are residential properties which have between 4 - 6 self contained apartments which are rented on assured tenancies by the managing agent. Rent is assessed based upon the lease rent required by the owner plus the other usual charges. Each tenant is supported with applications for housing benefit. Each tenant is assessed by their Social Worker for a personal budget. There is no supporting people funding associated with any of the schemes.

I hope this is helpful to outline that it can be done, and it works well to bring choice and independent living to individuals with a disability. Anne

Hi, I have read these various posts ad Anne's response. I have set up a semi-ind house for ex care leavers in conjunction with my LA as I am also a foster carer. I am not sure they have really done this correctly....more an ad hoc arrangement which I feel unhappy about as is not well organised. I want to take more control myself and be able to offer my housing services to a wider range of other LA etc. I have several houses some in student residency so they would be ideal for setting up for vulnerable yp or ex care leavers. I offer some outreach work and key work with the yp but NOT personal care, more budgeting skills, debt management, helping with form filling etc. I am ready to give up as I just don't know what I need to do to set up properly, we have a dormant company and a partnership arrangement set up to use if needed but nobody really seems to know what/if anything we need to do to be more "official" - I am constantly being told this sort of housing is needed and we love working with the yp and would want to eventually move out of fostering and into just this work with the yp who leave us so any help or guidance is much appreciated.

I would say your questions around setting up as supported housing providers should initially be directed at the local authority where you intend to operate. They should guide you. You may want to speak to their homelessness team or resettlement team. Though, these are challenging and uncertain times for supported housing providers due to welfare reforms.

Has anyone heard of Intensive Housing Management?. This is a slightly different model to supported housing. You will be providing housing management to your tenants and convincing the housing benefit decision maker for the local authority is the deal breaker. Hi there,

My sister who has learning disabilities, cerebral palsy and Epilepsy, requires 24 hour care, a home has been purchased on her behalf in order to begun living independently. It is a large property with 5 bedrooms. Me and my parents intend to manage this as a supported living home for her and 3 other residents as we do not want her to live a lonely life and would like her to have housemates and activities in the home, it is very early days and we are meeting with the Local Authority next month to discuss this further. I am a social worker of 6 years and will become a registered manager for the home. My sister will somehow be the registered landlord and receive rent and we would set up as the registered care provider.

If anyone could offer some support to us in the setting up of such provision, particularly around the legalities associated with someone who lacks capacity having someone act as a registered landlord on their behalf, we would really appreciate it.

I have read through some of the post and found them to to be very useful.

I am currently looking to set up a small semi-independent support lodging for young care leavers in my area, however I've found that there is very limited information in my area on how you go about setting this up? I have been working in social care for over 8 years and I am qualified in Health and Social Care. Working with children and young people is a passion of mine and it has been my goal to set up something on my own.

I am desperate in finding out how and if possible to do. I f anyone has any advice or information they can offer regarding the legalities, costing, referrals and just the basics of getting something like this up and running, would be very much appreciated.

Hi this is my first post and want to share both my partners and myself s hurdles, drawbacks, sleepless nights, worries etc. we have had over the last 18 months, and are still experiencing.
Between us we have 25 years experience supporting adults with learning disabilities and are both passionate about providing the best possible care and support to individuals with learning disabilities. It had been a desire for both of us before we met to have our own business where the tenants come first so we agreed we would do it, I'm sure their are many out their who have worked for organisations where this doesn't happen. We found an idea property suited for shared accommodation for up to four tenants, the landlord who has disabilities is adamant that individuals with learning disabilities live their and is delighted with our plans.
We registered with Company House and then started the process of completing the application forms for CQC registration. We initially applied as new providers for residential care as that is what we were used to.
Eventually after a considerable time we were visited by two inspectors who were very helpful and supportive and they suggested we go down the route of supported living as that's the future, individuals living in the community in normal houses in a normal street, out and about in the community, have more choice and control over their lives etc.
After researching supported living we agreed that's the future and decided to apply to CQC to enable us to provide personal care.
This meant forming another company so now we have two as the care side of the business (CQC) must be separate from supported living as funding will come from two sources, such as housing benefit, social services.
We now need two bank accounts.
We had another visit from CQC and needed to put a few more things in place which was done.
We new an excellent ex manager and friend who applied to CQC as our registered manager and was successful, we became registered as new providers with CQC enabling us to provide personal care
Great Big hurdle overcome.
Next step the accreditation process, contracts with the County Council as cant apply until registered with CQC.
We completed the forms enclosing all the info required and their is lots. Over three months later and after several calls to social services we were visited by the Quality Assurance dept.
The visit went well and she appeared delighted with the property and everything in place and our knowledge regarding MCA DOLS Person Centred Care and everything involved with providing an excellent service.
We had calls wanting more information which we expected and just before Christmas we had a phone call informing us that we had been successful and will be added to the list of accredited providers, and in the new year we signed contracts.
We felt great all that hard work, expense, sleepless nights, constant worry was finally paying off.
Since signing we have made calls to social services asking for advice such as do we have to inform a department that we have rooms available etc. During a conversation with a senior member of staff at social services he said they are not sure if there is a need for a small establishment.

We have done everything, spent tens of thousands on property, CQC required work done on house to comply with Health and Safety which we did. Everything is in place, insurance, manager, accountant for PAYE, policies and procedures, all relevant paperwork, training program, following fire risk assessment all doors extinguishers etc. alarms in place. Everything is ready.

Yesterday told by council we are unsure if their is a need for our type of property.

Am I wrong but isn't this what the Government want. Those with Learning Disabilities able to live in the community with support move out of large residential homes and live like you and me having control over their lives.

Sorry I have run on but wonder if any others have experienced similar.
Will keep you posted as I am now writing to my local MP, Jeremy Hunt and The Executive Director of Adult Social Services County Council.

I am new to this site and am amazed at how many people are in the same boat as me.
I currently have two ladies living in our family home under shared lives, we would like to set up a supported living accommodation so that we can offer more people the opportunities we have been able to offer up until now.
We live in Kent and are finding it difficult to rent larger properties, I have found a 9 bedroom bed and breakfast with a flat for sale, so we could live in it and provide the 24 hour support, individuals can choose their own 1:1 support.
We are looking for people to invest in this, our commitment is 24 hour support to all individuals for a minimum period of 20 years, this will take us up to our retirement!
We are looking for either a landlord or investor or group of investors to fund the project and have set out returns etc for their investment.

I really want to set up a supported living establishment but have no ideals where to start. Once it's started I have every faith that it can be a successful service as I have created and developed services previously.

I have a few homeless hostels and work with registered social landlords, I want to go down a different path. I have 2 properties in Birmingham next door to each other under bromsgrove local authority and would be 10 bedrooms. I want to set up a supported/assisted living accommodation for either leaving care kids or adults with learning difficulties. I have been told to get planning and then to get inspection done with CQC but I don’t know which one of the two I should do and how would the paper work side of things work as in the homeless trade I used the rsl paperwork to get that done but I want to be direct with the local authority. Hello Riaz,

If you want to set up supported living for kids which are the care leavers 16-18 years old semi-independent living, you do not need to register with CQC. If you have two properties why not set up both for the adults and the kids.

If you set up the adults which is the supported living you will need to register with CQC if you are going to provide Personal Care because it is one of the Regulated Activities. Tips the local authority is only accepting application from service providers who are registered with CQC especially if you are providing your service to adults with learning disabilities.

The care leavers are the quickest of the two to set up and to get referrals from the Local Authority. The paperwork for the care leavers is very different to the adults paperwork.

The planning you may need to get is to register for HMO Licence if you are having 5 unrelated people in the property at any one time and that apply to both the adults and the care leavers 16-18 years old.

CQC will only inspect the property with regards to Data protection, securing confidential information and what relevant documents you have in place Fit For proper Person Director and policies & procedures etc.

HMO inspector will inspect the property to ensure it comply with the fire and safety and if the property can accommodate 5 unrelated people and of course room sizes.

You can work direct with the local authority by registering with them via their website

You need to contact the local authority and introduce your self and your new business. Alternatively you can go through a social worker to get a referal from local authoirity.

 Also you will have to contact the CQC for inspecting  the property and approval before you can put anyone in. I hope this information help? Thanks.
