Mental capacity and terminating occupancy agreements

As the Dementia Lead for the Housing LIN, I have been told that relinquishing a tenancy or lease when the occupant loses the mental capacity to agree is becoming a growing problem when there is not a Lasting Power of Attorney or court-appointed Deputy in place. We hoped this might have been addressed in the Law Commission's review of the Mental Capacity Act and DoL, but it wasn't. I have suggested to them that it might be something they could look at. Please let me know if this is something you are concerned about.
