Chief Coroner's Guidance

This guidance written by the Chief coroner considers whether the death of someone under a deprivation of liberty authorisation should be reported to the coroner. It reaches the following conclusion: "The Chief Coroner's present view, subject to a decision of the High Court, is that any person subject to a DoL is 'in state detention' for the purposes of the 2009 Act [Coroners and Justice Act 2009]" and that therefore the death should be reported to the coroner. This is something providers of Housing with Care need to know if any of their tenants have been deprived of their liberty under an order from the Court of Protection.
